Pre-Nuptial Agreements

At Kirwans was can advise on and draft pre-nuptial agreements if required.

Pre-Nuptial Agreements are agreements entered into before marriage setting out what the distribution of money/assets will be in the unfortunate event divorce.

Prenuptial agreements are not legally binding as an enforceable contract by the Courts, but they may be considered as one factor amongst many, as a statement of intention. They are most likely to be taken into account when the marriage has been short, and there are no children.

We also strongly recommend that if you are presented with a prenuptial agreement that your partner has drawn up, you take legal advice before you sign it.
