Transfers and Undertakings (TUPE)

TUPE law seeks to protect your rights and prevent you from being treated unfairly when a business moves from one owner to another. The TUPE legislations stipulate that the contract between you and your employer is transferred without any changes to your new employer.

 

The TUPE law regulations protect you from any subsequent dismissal or significant change to your terms and conditions that come as a result of the transfer of ownership. If this happens, it may be classified as unfair dismissal depending on the circumstances.

If you find yourself in a situation where your employment has been terminated by a new employer after the business or undertaking that employed you previously changed, you may well have a case against your new employer.
